Tactical Meeting on Guidelines for the investigative police in information investigations:

towards a European prospect

BRIEFING NOTE

Milan, 26 January 2008

Introduction
In November 2007 Eurojust supported a coordination meeting between Italian and Romanian authorities regarding a case of “phishing”.
The assistance of Eurojust in this case allowed a real time exchange of information and the prompt execution of several rogatory letters and European Arrest Warrants.
Further developments in the investigations indicate the existence of a criminal organisation operating cross-border to commit frauds and the importance of getting reliable forensic evidence in computer crime cases.
The relevance of this topic is clear also by looking at the general recent crime trends. Computers and IT technologies appear to be an increasingly important facilitating factor for the commission of crimes (see 2007 Europol OCTA report - restricted version, in particular p. 42-43).
This trend is confirmed in the Eurojust casework, with several cases of crimes committed through the use of IT technologies (bank frauds committed through the internet, child pornography through the internet, use of internet to recruit terrorism adepts, wired financial transactions, etc.).
Scope of the meeting
In light of the above background, Eurojust has decided to organise, together with the Public Prosecution Office of Milan, a tactical meeting on “Guidelines for the investigative police in information investigations: towards a European prospect” to be held in conjunction with the Symposium on “New Perspectives of the anti-fraud investigation activities in Europe”.
The focus will be on computer crimes investigations, drawing on the experience of the Public Prosecution Office of Milan, the Legal Electronic Forensics Team and I.I.S.F.A.
Method, structure and expected outcomes
Delegations of judges/investigative police from selected EU Member States will participate (taking advantage of the opportunity of being in Milan for the symposium). They will be asked to answer a questionnaire and provide documents and case experience on the field.
The aim of this exercise is to exchange information on current investigations in the cyber crime field and identify best practices in the handling of computer evidence so that it can be used in cross-border prosecutions.
The results of the meeting will be compiled and disseminated through Eurojust to the MS judicial authorities.
